- Top Pursuit is a sales training and practice app. You need to be 18 or older to use it.
- Paid plans renew automatically until you cancel. You can cancel any time and keep access to the end of the period you've paid for.
- AI coaching can be wrong. Use your own judgement on real deals.
- What you put in is yours. Only share your employer's or customers' information if you're allowed to.
This summary isn't a substitute for the terms below.
1. Who we are
Top Pursuit is a trade name of Storyline Studio Inc., a corporation in Edmonton, Alberta, Canada ("Top Pursuit", "we", "us"). These terms are an agreement between us and you, the person using Top Pursuit's website at toppursuit.ca and app at app.toppursuit.ca (together, "the service"). If you use the service for a company, you also confirm that you're allowed to accept these terms for it.
By creating an account or using the service, you agree to these terms and to our privacy policy and refunds and cancellation policy, which form part of them.
2. Your account
- You must be at least 18 years old and able to enter a binding contract.
- Give accurate information when you sign up, and keep it up to date.
- Keep your sign-in details to yourself. Each account is for one person; don't share it.
- You're responsible for what happens under your account. Tell us at [email protected] if you think someone else has used it.
3. Company accounts (Team Pursuit)
A company on Team Pursuit has one or more company admins, who manage its plan, its seats and its company profile. The company admins decide who joins, and can add or remove people. If you join a company account:
- The company's profile fills in and locks some of your profile details while you're a member.
- Company admins and managers can see who has a seat and the company's plan and billing. As team reporting is available, they can also see your training progress and practice scores.
- Your roleplay conversations and your Virtual Sales Manager conversations stay private to you. Company admins and managers can't see them.
- If you leave the company or are removed, your own account and personal workspace stay yours.
The company is responsible for paying for its seats and for the people it adds.
4. Plans, trials and payment
Our plans, what each includes and current prices are on our pricing page. Prices are in Canadian dollars and don't include GST/HST, which we add based on your billing address.
Subscriptions renew automatically
Paid plans are subscriptions, billed monthly or yearly in advance. They renew automatically at the end of each billing period, at the price then in effect, until you cancel. By subscribing, you authorise us, through our payment processor Stripe, to charge your payment method on each renewal, for seats added during the term and for any extra voice minutes you buy.
Free trial
Pursuit comes with a 14-day free trial, once per person. You add a payment method to start it. We'll email you before the trial ends. Unless you cancel before it ends, your plan starts and your payment method is charged on the billing you chose.
Voice minutes
Paid plans include a monthly allowance of voice roleplay minutes that resets on your billing day; unused included minutes don't carry over. Extra minutes bought as top-ups last while your plan is active and end when it ends. Text roleplay and other AI features are subject to fair use: normal use by one person, not automated or bulk use.
Price changes
We may change our prices. We'll give you at least 30 days' notice by email before a new price applies to your plan, and it will apply from your next renewal after that notice. If you don't want to continue at the new price, you can cancel before it takes effect.
Failed payments
If a payment fails, we'll let you know and try again. You keep full access for 7 days. After that, paid features pause until the invoice is paid. Your account and data aren't affected.
Pre-authorised debit
If your company pays by pre-authorised debit, the debit agreement you accept at checkout applies alongside these terms.
5. Cancelling and refunds
You can cancel any time from Plan and billing in your account. Our refunds and cancellation policy explains what happens when you cancel, when refunds are available, and how seat changes on Team Pursuit are billed.
6. AI features
Roleplay, call scoring and the Virtual Sales Manager use artificial intelligence. Please keep in mind:
- AI responses can be inaccurate, incomplete or inconsistent. Practice buyers are fictional, even when they're modelled on the kind of customers you describe.
- Coaching and scores are training aids, not professional, legal or financial advice. You're responsible for decisions you make on real deals.
- Don't rely on the service for anything where a mistake could cause harm.
7. Your content
"Your content" means what you put into the service: your profile, the text and speech in your roleplays, transcripts you paste in for scoring, and what you discuss with the Virtual Sales Manager. You keep ownership of your content. You give us permission to store, process and transmit it only as needed to provide the service to you, to keep it secure and to support you, as described in our privacy policy. We don't sell your content and we don't use it to train AI models.
Your employer's and customers' information. When you practise or talk through a real deal, you may be sharing information that belongs to your employer or your customers. Only share what you're allowed to share. We recommend keeping company and contact names generic. If you paste in a transcript of a real call, make sure you had the right to record it and to share it.
8. Acceptable use
Don't use the service to:
- break the law, or infringe anyone's rights, including privacy and intellectual property rights;
- upload recordings or transcripts of people who didn't agree to be recorded where their agreement is required;
- harass, threaten or abuse anyone, including in the community;
- get around plan limits, voice minute allowances or trial rules, for example by opening extra accounts;
- access the service by automated means, scrape it, overload it, or try to break its security;
- copy, resell or reverse engineer the service, or use it to build a competing product;
- try to make the AI produce content that is unlawful, hateful, sexual or otherwise harmful.
9. Community
When the community opens, posts there are visible to other members. Don't post anything confidential, including customer names, pricing or your employer's information. You can post under a display name. We may hide, edit or remove posts, lock threads and suspend posting for anyone who breaks these terms or the community guidelines. By posting, you give other members permission to read your post and us permission to show it in the service.
10. Our content
The Top Pursuit playbook, training lessons, quizzes, practice scenarios, the app and the website belong to us or our licensors. While you have an account, you may use them for your own training and your own work, or for your company's team if it's on Team Pursuit. You may not copy, publish, sell or share them outside the service. Certifications, when offered, may be shown on your professional profiles as long as they're accurate and current.
11. Support and staff access
To help you or fix a problem, Top Pursuit staff can access your account's settings, profile, plan and billing. Staff access requires two-factor authentication and every staff action is logged. Staff can't read your Virtual Sales Manager conversations. Support is by email at [email protected]; we aim to reply within two business days.
12. Changes to the service
We're improving Top Pursuit all the time. We may add, change or remove features. Some features are marked as coming soon or as early versions, and may change. If we remove a core feature of a paid plan, we'll tell you in advance and you can cancel; if you do, we'll refund the unused part of any annual payment. We aim to keep the service running but can't promise it will always be available or free of errors.
13. Suspension and closing your account
You can stop using the service and ask us to close your account at any time. We may suspend or close an account that breaks these terms, puts other users or the service at risk, or that we're required to close by law. Where it's reasonable, we'll warn you first and give you a chance to fix the problem. If we close a paid account for reasons other than a breach of these terms, we'll refund the unused part of any annual payment.
After an account is closed, we delete or anonymise its data as described in our privacy policy.
14. Warranties and liability
The service is provided "as is" and "as available". To the extent the law allows, we don't make promises about it beyond those in these terms, including that it will produce any particular sales result.
To the extent the law allows, we're not liable for indirect or consequential losses, such as lost profits, lost deals, lost revenue or lost data, and our total liability to you for any claim about the service is limited to the amount you paid us in the 12 months before the claim arose (or CA$100 if you're on Free).
Nothing in these terms limits any right you have under consumer protection law that can't be limited by agreement.
If you use the service for a business and break these terms or the law, you agree to cover our reasonable costs of claims brought against us by others because of it.
15. Consulting services
Top Pursuit's consulting engagements (Diagnose, Build and Operate) are provided under a separate written agreement, which takes priority over these terms for that work.
16. Governing law
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. You and we agree to the courts of Alberta, sitting in Edmonton, unless the law where you live gives you the right to bring a claim in your local courts. Before going to court, please contact us so we can try to resolve the issue.
17. Changes to these terms
We may update these terms. We'll post the new version here with its date, and for changes that matter we'll email you at least 30 days before they apply. If you keep using the service after that, the new terms apply. If you don't agree, you can cancel before they take effect.
If part of these terms can't be enforced, the rest still applies. These terms, with the policies they mention, are the whole agreement between you and us about the service.
